Most electronic resources are protected by copyright and also subject to a variety of licensing restrictions on access and use. Your campus may also have additional policies that govern the use of electronic resources. Additional restrictions on usage
Printing: Permitted. Note: print a reasonable number of pages from each eBook, and make a reasonable number of photocopies of those printed pages, for the scholarly or research use of Authorized Users
Downloading: Silent. Note: Restrictions. Except as expressly permitted in this Agreement, Licensee and its Authorized Users may not: (1) download or access the Licensed Products from IEEE Xplore in a manner that has a material negative effect on IEEE servers, bandwidth or other network resources;
Sharing: Prohibited. Note: Except as expressly permitted in this Agreement, Licensee and its Authorized Users may not: display or otherwise make available any content from the Licensed Products to anyone other than Authorized Users
Other Access Restrictions: E-Reserves note: post a reasonable number of eBooks in PDF format for the purposes of electronic course reserves on Licensee's secure website, provided that Licensee removes such eBooks within ninety (90) days after the conclusion of the course. ILL Note: print and deliver one (1) chapter per eBooks title to fulfill requests from non-commercial libraries located within the same country as Licensee as part of the practice commonly known as "interlibrary loan," provided that such practice complies with Section 108 of the U.S. Copyright Act and the guidelines developed by the National Commission on New Technological Uses of Copyrighted Works (CONTU Guidelines).
Restrictions on library services
Interlibrary Loan: Permitted
Interlibrary Loan Delivery: Print or fax. Ariel/Odyssey. Follow CONTU guidelines.
E-reserves: Permitted, delete upon cessation of use.
Archiving: IEEE shall provide access to the Licensed Products via IEEE Xplore; provided, however, that IEEE may, at its option, discontinue access via IEEE Xplore and provide Licensee with a fixed copy of the Licensed Products on a mass storage medium. Perpetual Access: No. Note: Events Upon Termination. Upon termination of this Agreement, Licensee shall cease all use of and access to the Licensed Products and delete all copies of eBooks in its custody or control.

Breach instructions: Material Breach. Either party may terminate this Agreement in the event of a material breach by the other party that remains uncured thirty (30) days after the non-breaching party gives the breaching party written notice of such breach. Suspension. In the event that IEEE notifies Licensee of a material breach of Section 3(c)(1) of this Agreement, IEEE reserves the right to suspend Licensee's access to the Licensed Products. IEEE will make commercially reasonable efforts to limit suspension to the offending IP address or user account, to the extent that the offending IP address or user account can be reasonably ascertained under the circumstances; otherwise, IEEE reserves the right to suspend all online access to the Licensed Products by Licensee. The suspension shall remain in effect until Licensee has cured the material breach, and Licensee shall not be entitled to a refund of any fees during such suspension. If Licensee does not cure the material breach within thirty (30) days after notice of such breach, IEEE shall be entitled to terminate this Agreement. Events Upon Termination. Upon termination of this Agreement, Licensee shall cease all use of and access to the Licensed Products and delete all copies of eBooks in its custody or control.
General Note: Withdrawal of Content. IEEE reserves the right to withdraw from the Licensed Products content that it no longer retains or has the right to license, or that it has reasonable grounds to believe is unlawful, harmful, false or infringing. Should fifteen percent (15%) or more be withdrawn from the Licensed Products content, and remain uncured for a period of thirty (30) days after the Licensed Products content is removed, Licensee may terminate this Agreement and shall be eligible to receive a pro-rata refund of the License Fee for the then-applicable term.
